Plaintiff appeals from a judgment granting defendant Joyce Byrd’s (defendant) motion for a directed verdict at the close of plaintiffs evidence. ORCP 60. Defendant makes a cross-assignment of error, arguing that the trial court erred in not granting a directed verdict in her favor on a different basis. We affirm.
