McGOWAN, Circuit Judge:

This is an appeal from a judgment in a garnishment proceeding. Appellee’s insured, it was alleged, injured appellant by negligently operating an automobile in which appellant was a passenger. Appellant obtained a default judgment against the insured, and then initiated these proceedings to garnish the proceeds of the insurance policy which ap-pellee had issued to its insured.
