This is an appeal by defendant Southern Railway Company from a judgment for plaintiff in an action for damages under the Federal Employers’ Liability Act, 45 U.S.C.A. § 51. The action was brought by the administratrix of the estate of O. L. Crosby, a brakeman employed by the Southern Railway Company, who was killed in the derailment of a freight train on which he was working. This train was being operated on the line of the Yadkin Railroad Company between Salisbury, N. C. and Albemarle, N. C.; and defendant contended that Crosby at the time of the derailment was an…
