Plaintiff seeks a writ of mandate to compel the respondent superior court to permit him to file an amendment to his complaint in an action for personal injuries.
The action arises out of an automobile accident that occurred on November 2, 1977, in which plaintiff’s vehicle was allegedly rear ended by a van driven by defendant Frederick Henry Vickers. Almost one year later, on November 1, 1978, plaintiff, acting in propria persona, filed a complaint alleging that the accident was. caused by the negligent driving of Frederick Vickers.
