For brevity the parties will be called herein the Ring Company and the Indemnity Company.

The Ring Company brought suit in the Essex Circuit against the Indemnity Company on two counts — first, in toft for deceit, and second, on a parol contract of insurance, which latter was abandoned at the trial. The first count alleges that Nearing was agent of the Indemnity Company to sell policies and make and enter into contracts, of insurance in the name of the company; that on or about December 31st, 1919, he induced the Ring Company to order…
