Nelson, Justice.

Defendant, Eugene Rainer, entered a plea of guilty to the charge of kidnapping and was adjudged guilty and sentenced by the district court. He now appeals from an order denying a new trial.

In an affidavit made a part of the record on the motion for a new trial, defendant claims the true circumstances are that on the night of December 7, 1957, he was in a cafe in St. James talking to the owner of the cafe, Mrs. Sally Bodin; that during the conversation he told her that he was going to Mississippi to see his brother.
