This is an appeal by the plaintiff, Houston Davis, from a judgment of involuntary nonsuit which the circuit court entered in favor of the defendant, Weyerhaeuser Company, upon its motion after the plaintiff had presented all of his evidence and had rested. The action was of the kind which is commonly termed personal injury. There were two defendants during the course of the trial in the circuit court. We have mentioned one of them, Weyerhaeuser.
