SOPER, District Judge.

The plaintiff corporation is the assignee and owner of the patent to Aaron Freydberg, No. 1,457,625, issued June 5, 1923, on an application filed February 12, 1923. The bill alleges infringement of the patent by the defendant, and prays an injunction and an accounting for profits. The answer sets up the invalidity of the patent, and relies upon disclosures of the prior art and prior public use.
