Before this Court is the Department of Labor and Industry of the Commonwealth of Pennsylvania in its capacity as custodian of the Workmen’s Compensation Supersedeas Fund (Fund) under Section 443 of The Pennsylvania Workmen’s Compensation Act, (Act),1 seeking review of an order of the Workmen’s Compensation Appeal Board (Board).
