LEVINE, Justice.
Robert V. Bolinske filed a complaint in district court, seeking to permanently enjoin the North Dakota State Fair Association (the Association) from interfering with his right to freely circulate initiative petitions at the North Dakota State Fair. The court granted the Association’s motion for a summary judgment, dismissing Bolinske’s complaint on its merits, and Bolinske appealed.
