WEINSTEIN, Judge.

This dispute regarding the timeliness of defendant’s lease payments is before the court on defendant’s motion to dismiss for lack of subject matter jurisdiction, and the parties’ cross-motions for summary judgment. Because plaintiff submitted and the contracting officer (CO) finally decided a valid claim under the Contract Disputes Act of 1978(CDA), 41 U.S.C. §§ 601-13 (1994 & Supp. Ill 1997), the court denies defendant’s motion to dismiss for lack of jurisdiction.
