MEMORANDUM AND ORDER

JACKSON, District Judge.

Plaintiff Investment Company Institute (“ICI”), the Washington-based trade association of mutual funds, advisers, and underwriters, sues for declaratory and injunctive relief against the United States, the Federal Deposit Insurance Corporation and its board of directors (collectively the “FDIC”) and the Boston Five Cents Savings Bank, a mutual savings bank chartered by Massachusetts, and certain “affiliates” (collectively “Bank and Affiliates”). 1 The controversy centers on a ruling of the FDIC of September 1,1982, which, plaintiff alleges, permits…
