This is the Commonwealth’s appeal from the allowance, in part, of the defendant’s motion to dismiss a murder indictment on grounds of prosecutorial delay in violation of the Interstate Agreement on Detainers (Agreement), St. 1965, c. 892, § 1. The crime occurred in 1980, at which time a complaint *286for murder was issued against the defendant from District Court. The defendant could not be found until 1993, when authorities located him in a Texas prison.
