OPINION

DOYLE, Justice.

This is an appeal from a conviction for the offense of exhibiting obscene materials, consisting of two motion picture films entitled “Fantasy” and “More Than Sisters.” The jury assessed punishment at a fine of $1,500, probated for one year.

On July 29, 1981, police officers Terral and Bollier went to the Art Cinema Theater, purchased two $6.00 tickets from someone other than appellant, and entered the theater. While viewing the movies, “Fantasy” and “More Than Sisters”, the officers talked into a tape recorder describing the films. Officer Terral then prepared a report…
