MEMORANDUM OPINION AND ORDER
BUCKLO, District Judge.
Richard Ringswald was arrested on October 23, 1999 and taken into custody at the DuPage County Jail, where Sheriff Zaruba is the executive officer responsible for the daily operation and policies of the jail. In addition to the bail set by the Circuit Court of Du-Page County, Mr. Ringswald was required to pay a nonrefundable $15 fee to secure his pretrial release.
