MEMORANDUM OPINION
LAMBERTH, District Judge.
This case comes before the Court on defendants’ motions to dismiss for lack of subject matter jurisdiction and for failure to state a claim upon which relief can be grant ed and, in the alternative, for summary judgment.
BACKGROUND
