Rumsey, J.:

This is an action brought by one of the legatees under the will of Albert P. Sturtevant, against the executors and other persons *305interested in that will, to obtain a construction of it. The executors who were made parties defendant also demanded in their answer a construction of the will. As a result of the trial the court found substantially that the different provisions of the will were valid and construed it in accordance with the contention of the executors and judgment was entered accordingly.
