COFFEY, Circuit Judge.

Appellant Thomas Bryan appeals the district court’s sua sponte dismissal of his complaint under 42 U.S.C. § 1983 after he *456paid a partial filing fee of $21.09. We vacate the district court’s order dismissing the complaint and remand with instructions to the district court to issue the summons to the defendants.
