Tbe action arises out of a contract for the construction of the Grand avenue viaduct in the city of Milwaukee, made October 21, 1908, between the National Engineering & Construction Company and the defendant, pursuant to the provisions of c'h. 444, Laws of 1903. The plaintiff’s appeal raises the question whether certain findings of "fact adverse to it are against the clear preponderance of the evidence.
The defendant’s appeal raises a like question. Defendant also contends that many of the findings of fact and conclusions of law were based on an erroneous conception of the law and on an erroneous construction of the contract involved, and that the conclusions of law are not supported by the facts found, conceding that there is sufficient support in the evidence, for the findings of fact made.…
