Prior to January 13, 1931, Francesco Giar-dina, a widower, forty-four years of age, had been in the employ of the plaintiff for about seventeen years. On that day he was engaged in tightening rail joints and repairing frogs on plaintiff’s track. Upon returning to’ his sister’s home where he resided, at about a quarter to five on that day, he first went to the bathroom and washed.
