The plaintiff, Public Market Company, instituted this suit on the equity side of the court against the City of Portland, praying for specific performance of a contract and for an accounting. The city demurred to the complaint upon two grounds: (1) that the complaint failed to state facts sufficient to constitute a cause of suit, and (2) that the court had no jurisdiction of the subject of the suit for the reason that the plaintiff had a complete and adequate remedy at law.
