BOWNES, Senior Circuit Judge.
We are asked to decide an issue of first impression in this circuit, namely, what pe riod of limitations following a final agency-decision applies to an action alleging age discrimination brought by a federal employee pursuant to the Age Discrimination in Employment Act (“ADEA,” “the Act”), 29 U.S.C. § 633a. There is also an issue of equitable tolling. Plaintiff-appellant Stanley J. Lavery appeals from the dismissal by the district court of his age discrimination claim against his employer, defendant-ap-pellee, the Secretary of the Army (“the Secretary”). See…
