Appeal from an order of the Supreme Court at Special Term (Cobb, J.), entered December 1,1982 in Columbia County, which granted defendant’s motion for summary judgment dismissing the complaint. By quitclaim deed dated July 9, 1980, plaintiff acquired title to a one-acre parcel of land located in defendant Town of Kinderhook, subject “to any easements and agreements, recorded or *899unrecorded”. Plaintiff then applied to the town zoning board for site plan approval and a building permit so that he could construct a Convenient Food Mart on the lot.
