delivered the opinion of the court:

The plaintiff-appellee was subpoenaed to appear and testify before a subcommittee of the Executive Committee of the Illinois House of Representatives. The defendant-appellant was the Chairman of the subcommittee and the subpoena was signed by him. The plaintiff brought an action seeking a declaratory judgment and injunctive relief on the ground that the defendant had no authority to subpoena him because the subcommittee was improperly created.
