This certiorari proceeding is brought to test the power and jurisdiction of the district court in setting aside a dis missal of a cause-of action therein and reinstating the same on the calendar. A partnership brought the action, and a-purported dismissal was made by certain alleged partners. Consequently a question arises concerning the authority of such partners to make the alleged dismissal.
