The plaintiff in error, hereinafter called defendant, was convicted in the district court of Latimer county of the theft of live stock, and his punishment fixed at imprisonment in the penitentiary for a term of three years.

Defendant was jointly charged with Bob Simpson. A severance was had, and Simpson was convicted and appealed to this court, and judgment was affirmed. Simpson v. State, 52 Okla. Cr. 311, 4 Pac. (2d) 126.
