The plaintiff in error, hereinafter called defendant, was convicted in the district court of Latimer county of theft of live stock and was sentenced to serve a term of 4 years in the penitentiary.

The principal contention made is that the district court was without jurisdiction for the reason that no transcript of the magistrate showing a finding of prob able canse at the preliminary was ever filed in the district court. When defendant was arraigned in the district court, he filed a motion to quash the information, alleging that the transcript was wholly insufficient to give the district court…
