— Qn Mar. 14, 1907, the respondent, Tamarack and Chesapeak Min. Co., filed an application for patent in the local land office at Coeur d’Alene, Idaho, for the Monroe lode mining claim. Within the time prescribed by law the appellant filed an adverse suit pursuant to sec. 2326 of the Rev. Stat. of the United States, claiming title and the right to possession of the Silent Friend mining claim, a portion of which it was claimed was in conflict with the Monroe mining claim.
