Johnny A. Johnson sued his employer, the City of Gadsden ("City"), on September 17, 1993, seeking to recover workers' compensation benefits for injuries he had sustained to his neck and back on February 15, 1993, during the course of his employment. Following an ore tenus proceeding on April 18, 1995, the trial court, on October 4, 1996, found, among other things, that the injuries sustained by Johnson had resulted in a 90% loss of earning capacity and a 90% vocational impairment.
