OPINION

BLISS, Judge:

Appellant, Mike Fish, hereinafter referred to as defendant, was charged, tried, and convicted in the District Court of Seminole County, Oklahoma, for the offense of Burglary in the Second Degree; his punishment was fixed at two (2) years imprisonment in the state penitentiary, and from said judgment and sentence, a timely appeal has been perfected to this Court.

On the 2nd of July, 1971, an information was filed in Seminole County, Oklahoma, against George Cooper, Richard Paul Fairbanks, and Mike Fish, charging these three individuals conjointly with the crime of Burglary…
