White v. State
Court of Criminal Appeals of Oklahoma
Appeal from District Court, Alfalfa County; M. C. Garber, Judge. Defendant was convicted of. the crime of manslaughter in the first degree and sentenced to thirty years’ confinement in the penitentiary, and he appeals. May White was convicted of the crime of manslaughter in the second degree and sentenced to two years’ confinement in the penitentiary, but her case is not before this court.

FURMAN, Presiding Judge.
1. Upon the trial of this cause counsel for the defendant objected to the introduction of any testimony upon the following ground:
“That the indictment does not allege that the homicidal act itself was done feloniously or without authority of law and with the premeditated design to effect the death of the deceased — that the mortal wound was so inflicted.”
The charging part of the indictment in this case is as follows:
“That in said county of Garfield, in said state of Oklahoma, on the 3rd day of March in the year of our Lord one thousand nine hundred and eight, Lowry…
