Haseen Herman Everette (defendant) was convicted on 20 February 2003 of two counts of assault with a deadly weapon inflicting serious injury, in violation of N.C. Gen. Stat. § 14-32(b); assault with a firearm on a law enforcement officer, in violation of N.C. Gen. Stat. § 14-34.5; and discharging a firearm into occupied property, in *239violation of N.C. Gen. Stat. § 14-34.1. The trial court entered judgment and found that defendant had a prior record level II.
