ARCENEAUX, District Judge.
This matter comes before the Court on motion for summary judgment filed by Atlantic Richfield Company (“Arco”). Having thoroughly reviewed the record, the memoranda of counsel and the law, the Court has determined that summary judg ment is appropriate for the reasons set forth hereinafter.
