This was an action in three counts, brought against the defendants, doing business under the name of the Brown Quadrieycle Company. The first count of the declaration is upon a contract in writing. By this contract the plaintiff agreed to make for the defendants one hundred quadricycles, according to working drawings furnished it, “ in all respects well constructed, of good material, and in good workmanlike manner.” The defendants were to furnish the necessary working drawings therefor, complete in all details, and agreed that they would “ accept and pay for all machines constructed according…
