This is an appeal from a judgment of the United States District Court for the Southern District of New York, Weinfeld, J., granting the motion of the Secretary of Health and Human Services (Secretary) for judgment on the pleadings. Plaintiff-appel-, lant Marie Robinson’s complaint was dismissed and her motion to certify a class was denied as moot.
