Procedural Background

Plaintiff Robert Richane (“Richane”) instituted this action against defendant Fair-port Central School District (“Fairport”), alleging that Fairport’s failure to hire him as a teacher constitutes age discrimination against him in violation of the Age Discrimination in Employment Act of 1967, 29 U.S.C. § 621 (“ADEA”), and the New York State Human Rights Law, N.Y.
