The plaintiff, Ronald B. Wheatley, filed a complaint with the Massachusetts Commission Against Dis crimination (MCAD) alleging that the defendants, American Telephone and Telegraph Company (AT&T) and Marc Rosen, terminated him because of his age in violation of G. L. c. 15IB, § 4 (1992 ed.). 2 The plaintiff subsequently withdrew the complaint and commenced this age discrimination action in the Superior Court pursuant to G.
