The accused in the case at bar was tried by a general court-martial for a violation of Article 85, Uniform Code of Military Justice, 50 USC § 679, under one specification alleging that he had absented himself without proper authority with intent to remain away therefrom permanently. He entered a plea of not guilty to the charge, but guilty to the lesser included offense of unauthorized absence.
