This suit was brought by the appellee against appellant to recover damages for personal injuries alleged to have been inflicted by the negligence of the company.

The substance of the allegations in plaintiff’s petition is: That while as a passenger on one of defendant’s electric street cars, in cross ing a bridge in the city of San Antonio, he, by the negligence of the company, came in contact with an upright girder of the bridge while in the act of stepping in to the car from the running board thereof, and was thereby knocked off and seriously and permanently injured;…
