This suit was instituted in the county court of Swisher county, Tex., by T. A. Gray and S. B. Dinwiddie, appellees, against the Pecos & Northern Texas Railway Company, the Southern Kansas Railway Company of Texas, and the Atchison, Topeka & Santa Fé Railway Company, appellants, to recover damages upon a shipment of 430 head of calves, shipped by appellees over appellants’ lines of railway about October 18, 1909, from Tulia, Tex., to Kansas City, Mo., appellees (plaintiffs in the trial court) alleging rough handling and delays en route; that said cattle should have reached Kansas City for the…
