— Order, Supreme Court, New York County (Kirschenbaum, J.) entered August 7, 1981, which, inter alia, denied a motion to dismiss the complaint brought by defendant-appellant Bayerische Motoren Werke, AG. (BMW-AG) pursuant to CPLR 3211 (subd [a], par 8), reversed, on the law, to the extent appealed from, the motion is granted, and the complaint is dismissed, without costs. The accident giving rise to this action occurred in West Germany while plaintiff was driving a BMW automobile he had purchased in New York for delivery to him in Munich under an arrangément called the European delivery plan.…
