MEMORANDUM DECISION AND ORDER ON DEFENDANT’S BANKRUPTCY APPEAL
WINDER, Chief Judge.
This matter is before the court on defendant’s appeal from the bankruptcy court, argued on April 25, 1996. At the hearing, Hollis S. Hunt represented the defendant/appellant Alka Patel (“Appellant”), and Gregory J. Adams represented the trustee/appellee Stephen W. Rupp (“Trustee”).
