—In an action to recover damages, inter alia, for false arrest and malicious prosecution, the defendants appeal, as limited by their brief, from so much of an order of the Supreme Court, Orange County (Barone, J.), dated May 5, 1994, as denied, in part, the defendants’ motion to dismiss stated portions of the complaint and granted the plaintiff’s cross application to amend his notice of claim.

Ordered that the order is modified, on the law, by deleting the provisions thereof that denied the branch of the defendants’ motion which was to dismiss so much of the complaint as is based on events…
