This matter is before the Court on Defendant Spirit Airlines, Inc.’s Motion for Summary Judgment [D.E. 17]. Petitioner William Tate, an airliner captain, filed this *1361action seeking review of a determination by the Spirit Airlines Pilots’ System Board of Adjustment (“Board”) affirming Respondent Spirit Airlines, Inc.’s decision to terminate Tate’s employment with Spirit.
