SEYMOUR, Chief Judge.
Douglas C. Shaffer, a pro se state prisoner, brought this action under 42 U.S.C. § 1988 asserting that requiring him to provide a DNA sample pursuant to Oklahoma law violates his constitutional lights. Specifically, Mr. Shaffer alleges that the operation of the state statutes denies him his rights under the First, Fourth, and Fifth Amendments, and under the Ex Post Facto Clause. The case was referred to a magistrate judge, who dismissed it for failure to state a claim upon which relief can be granted under Fed. R.Civ.P. 12(b)(6). Mr. Shaffer appeals and we affirm. 1
