Real party in interest HouReal Corporation (“HouReal”) filed a lis pendens in conjunction with., its original petition in the underlying suit. 1 The relator, Rescue Concepts, Inc. (“Rescue”), filed a motion to expunge the. lis pendens pursuant to Texas Property Code section 12.0071 and asked the trial.court to tax costs against HouReal in the underlying proceeding. The trial court denied the motion to expunge, and Rescue filed this petition for a writ of mandamus seeking to vacate the respondent trial judge’s order denying the motion to expunge.
