This proceeding in error seeks to review the judgment of the lower court in an action in which H. P. Meyer, as plaintiff, sued Joe Newkumet, as defendant, on a certain itemized account, wherein it was alleged that the defendant was indebted to plaintiff in the sum of $529.71 for goods, wares, merchandise, and money due him by defendant at his special instance and request. There was a general denial by the defendant.

Upon the trial to a jury, a verdict was returned for the plaintiff in the amount sued for, and judgment was entered accordingly, and defendant appealed.
