Appellant Richard Glen Sturgeon was indicted and tried by jury on a charge of aggravated robbery. Tex. Pen.Code § 29.03. During pre-trial motions, and again at the conclusion of the State’s case, defense counsel requested a writ of attachment for alibi witnesses who had failed to appear for trial. The trial court denied the request, and the defense did not call any witnesses at trial. The jury convicted appellant, and assessed punishment at 50 years imprisonment.
