MEMORANDUM AND ORDER

State inmate Richard Glen Sturgeon (TDCJ # 880922) has filed a petition under 28 U.S.C. § 2254, seeking a federal writ of habeas corpus to challenge a state court conviction for aggravated robbery. With the assistance of appointed counsel, Sturgeon has filed an amended version of his petition. (Doc. # 56). Pending before the Court is the respondent’s second motion for summary judgment.
