MEMORANDUM
DAVIS, District Judge.
Plaintiff, Fairbanks Capital Corporation (“Fairbanks”), instituted this action against defendants W. Craig Kenney and Brian Barr alleging federal trademark and copyright infringement and related state law claims arising out of defendants’ creation and maintenance of a website making substantial use of Fairbanks’ registered trademark. Fairbanks seeks, inter alia, preliminary and permanent injunctive relief and damages.
